Terms of Service

These Terms of Service (“Terms”) govern your use of GoldTwin at https://goldtwin.app (the “Service”), operated by GoldTwin (“GoldTwin”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. What GoldTwin does

GoldTwin is a tool for creators. You pick or create an AI influencer (an AI-generated character), choose a trending video or upload your own, and the Service generates a new video in which your AI influencer performs the same moves. Generation is done by third-party AI models, so results vary and may contain imperfections.

2. Who can use it

You must be at least 18 years old and able to form a binding contract. You're responsible for your account and for everything done with it. Keep access to your email and Google account secure.

3. Bars

• Generations are paid with bars, our in-app units. You buy bars in packs; the price is shown before you pay. Payments are processed by Stripe — we never see or store your full card number.
• Bars are a license to use the Service, not money. They have no cash value, can't be transferred or sold, and can't be exchanged for cash except as described in our Refund Policy or required by law.
• The cost of each video is shown before you start it and is deducted when generation begins. If a generation fails on our side, the bars are returned automatically.
• Bars you receive for free (rewards, promotions, gifts) have no value and may expire or be withdrawn.
• Purchased bars don't expire while your account is open. We may change prices for future purchases; that never affects bars you already have.

4. Your content

“Your content” means the videos, photos and text you upload or type, and the images and videos the Service generates for you. You keep whatever rights you have in your content. You give us a limited, worldwide license to store, process and display your content only to run the Service for you (including sending it to our AI providers to generate results). We don't use your content to advertise and we don't sell it.

You may use the videos you generate for personal and commercial purposes, including posting them on social media and monetizing them, subject to these Terms and the rules of the platforms where you post. AI influencers from our catalog stay ours: you may use them in videos you make with the Service, but you may not claim them as your own exclusive characters, register them as trademarks, or resell them.

5. Rules you agree to follow

You may not use the Service to create, upload or share content that:

• depicts a real person — their face, body or voice — without their clear permission, or impersonates anyone;
• involves anyone under 18 in any sexual, suggestive or harmful way, or depicts minors at all in uploaded videos without the permission of their parent or guardian;
• is sexually explicit, or is non-consensual intimate imagery;
• promotes violence, terrorism, self-harm, hatred or harassment of people based on who they are;
• is used to deceive people: scams, fake endorsements, fake reviews, election or medical misinformation, or passing off AI-generated people as real people;
• infringes someone else's copyright, trademark, privacy or publicity rights — upload only videos you have the right to use.

You also agree not to abuse the Service: no scraping, reverse engineering, getting around limits or payments, reselling access, or overloading our systems. Our AI providers apply their own safety filters, and a request may be refused.

6. Posting AI content responsibly

Your videos are AI-generated. When you post them, you're responsible for following the law and the platform's rules, including labeling AI-generated or synthetic content where required (TikTok, Instagram, YouTube and others require this) and clearly disclosing paid partnerships, sponsorships and affiliate links as required by the U.S. Federal Trade Commission and similar rules in other countries.

7. No promise of earnings

GoldTwin is a tool. We don't promise that you'll gain followers, views or any income. Results depend on your content, effort, the platforms and many factors outside our control. Any examples of results are illustrations, not typical outcomes.

8. Suspension and closing your account

We may suspend or close accounts that break these Terms, put others at risk or harm the Service, and we may remove content that breaks the rules. Where reasonable we'll tell you why. You can close your account at any time by messaging us at @behaltensie on Telegram. Unused purchased bars are handled as described in the Refund Policy.

9. The Service “as is”

We work hard to keep GoldTwin running well, but AI generation is unpredictable and the Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't guarantee that the Service will be uninterrupted, error-free or that results will meet your expectations.

10. Limitation of liability

To the extent permitted by law, GoldTwin won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or followers. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that can't be limited by law, or your statutory rights as a consumer.

11. Indemnity

If someone makes a claim against us because of content you uploaded or posted, or because you broke these Terms or the law, you agree to cover our reasonable costs and losses from that claim.

12. Copyright complaints

If you believe content on the Service infringes your copyright, contact us at @behaltensie on Telegram with your contact details, a description of the work, where the content appears, and a statement that you believe in good faith that the use isn't authorized. We'll review it and remove infringing content.

13. Changes

We may update these Terms. If a change is significant, we'll tell you by email or in the app before it takes effect. If you keep using the Service after that, the new Terms apply.

14. Law and disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you can bring claims in your local courts. Before any formal dispute, please contact us at @behaltensie on Telegram — most issues are solved quickly that way.
